Can you rent it your way?

Caution

Whether the deed and rules let you rent short-term on your own terms: no requirement to use the on-site program, no minimum stay that kills weekend bookings, and no rule against saying where the condo is.

STR with no stated minimum stay, self-management (the 2018 Policies address 'owner-managers' by name) and off-site managers are all allowed, so this is above a 1, but the Master Deed bans the resort name and every exterior/amenity/common-area picture from owner ads (interior photos only under a 2018 policy reading), every stay must be emailed to the on-site company's desk before the guest can get a key, the Exhibit F plaque must hang in any unit not managed by the on-site company, owners may not use any common element for the business of renting, reservations/front desk/key/concierge services belong to the commercial unit by deed, and off-site managers carry bold-type disclaimers, $1M/$2M insurance, cleaning notices and HOA inspection - far beyond a 3's 'registration/advertising rules', and changeable only with Grantor consent plus a unanimous vote.

Short-term rentalsAllowed
Must use on-site programNo
Owner may rent it personallyYes
Off-site manager allowedYes
Owner-use limitsNone stated. Owners may use, rent or lease their unit subject to the Master Deed; timeshare/interval ownership requires prior written approval of the Grantor and the commercial unit owner (Master Deed Art. XIV, file p. 10). Owners and their agents may not use any part of the common elements 'to engage in the business of renting' (reservations, key pick-up/drop-off, front desk, concierge are reserved to the commercial unit), and may not use the on-premises maid closets or linen chute (Art. XIV, pp. 10-11). The 2018 Policies & Procedures expressly address 'OWNER-MANAGERS' and 'Off-Site Rentals' as recognized categories and say off-site guests 'will be treated with the same courtesy as our own guests' (Policies 2018 p. 1). Occupancy of a unit may not exceed the number specified by law (Rules 2022 p. 1, GENERAL).
RegistrationEvery reservation: to schedule or confirm a reservation for an off-site rental the owner (or a rental agent on file) must email the on-site company's off-site reservations address with the owner's name, unit number, guest name, check-in and check-out dates; 'Only individuals on file as Owners or Rental Agents will be permitted to confirm a reservation for your unit.' At arrival the guest must show photo ID matching the name on file, sign for key pick-up, give a cell number and license plate(s); no keys are issued if the ID name and the name the owner supplied do not match (Policies 2018 p. 1). Housekeeping and maintenance personnel must have their name and company on file with the front desk (emailed authorization) before any key is issued, and sign keys in and out each visit (Policies 2018 p. 1). Master Deed layer: an off-site rental management company must notify the Grantor or the Grantor's chosen rental company who will perform cleaning; carry $1,000,000/$2,000,000 general liability naming Holiday Sands at South Beach Homeowners' Association, Inc. as additional insured, workers' compensation with waiver of subrogation, and a $15,000 third-party employee dishonesty bond; display the Exhibit F plaque in the kitchen and inside the entry door; meet the Exhibit G housekeeping/engineering standards; and submit to Association inspection of the units it rents (Master Deed Art. XXXIX, pp. 33-34). All vendors, visitors and other management companies must sign in and out at the front desk and pick up a unit key there each visit (Exhibit G, p. 72). The owner may be required to deposit a unit key with the Association at the front desk (Art. XVII, p. 12). No registration of the owner with the Association itself (beyond the Art. XXVI owner register) is stated.
Advertising rulesSevere. Master Deed: no residential owner or agent may use any pictures, representations or models of the exterior, interior, amenities or any part of the property in any rental advertisement, and may not use the name 'Holiday Sands' or 'Holiday Sands at South Beach Horizontal Property Regime' in any rental ad; the only rendering allowed is the recorded floor plan. The Grantor and its designated rental company are exempt. Off-site rental companies may not appear to be the official agency and their advertising must state in bold type that they are not the official rental management company of Holiday Sands at South Beach (Master Deed Art. XXXIX, file pp. 33-34). The 2018 Policies restate the ban on the names 'Holiday Sands', 'Holiday Sands South' and the regime name and on 'any pictures or representations of the property, building, amenities, or common areas', but allow 'the recorded plans, and photos of the interior of their own unit' - a softer reading than the deed's ban on interior pictures; the deed controls legally, so get the interior-photo allowance confirmed in writing (Policies 2018 p. 2). Owners also may not place any sign visible from outside the unit, including 'For Sale' signs (Art. XIX, p. 13).
Disclaimer in your listingRequired
Vote to change rental rulesThe Article XIV commercial-activity restriction (which reserves rental management, front desk, concierge, key pick-up etc. to the commercial unit) cannot be amended without the consent of the Grantor, its successors and assigns, AND the unanimous vote of all unit owners (Master Deed Art. XIV, file p. 11). Rights reserved to the commercial unit(s) can only be altered with the express written consent of the Grantor and all commercial unit owners (Art. XXIX, p. 26). Other Master Deed provisions, including the Article XXXIX advertising/off-site manager rules, amend by affirmative vote of 67% of the members owning a unit (Art. XXIX, p. 26), but any provision reserving a right to the Grantor needs the Grantor's written consent (pp. 26-27). Rules and regulations are made and amended by the Board alone (By-Laws Art. III Sec. 18(f), p. 62; Master Deed Art. XIII p. 9), but rules that affect the commercial unit or Grantor-reserved rights bind only with the Grantor's written consent (Art. XV p. 11).

Will your guests be treated like guests?

Typical

Whether a guest who booked through you gets the same resort as a guest who booked through the front desk: the same pools, parking, wristbands and check-in, or a second-class version of them.

Off-program guests hold the same perpetual easement over every common-element amenity as owners plus reciprocal use of the adjacent hotel's pools and exercise room, no document excludes them from any amenity, and the on-site front desk hands them keys after a photo-ID check once the owner has emailed the reservation, which is better than owner-run key handoff; but the desk gives them no housekeeping, maintenance, supplies or mail, the mandatory plaque tells them the front desk is not responsible for their unit, parking is capped at one or two garage spaces, trash goes to ground-floor bins, and the hotel owner shares the pools and can set identification rules and closures - same amenities with partial front-desk service and a required disclaimer, so a 3.

Amenities for your guestsSame as program guests
Off limits to your guestsFood, beverage and retail sales on the common elements and pool decks are exclusive to the CU-1 owner; owners may not sell or vend to their guests (Master Deed Art. XIV p. 10; Exhibit B p. 43), On-premises maid closets and linen chute are reserved to the commercial unit owner (Art. XIV p. 11), Front desk, concierge, reservations and key pick-up/drop-off services are reserved to the commercial unit; off-program guests are told in the Exhibit F plaque that the front desk has no control over their unit (Art. XIV p. 10; Exhibit F p. 71), On-site housekeeping, maintenance services and supplies are not provided to guests of off-site rentals except in an emergency or a threat to common areas or other units; on-site employees may not enter or service an off-site unit without management authorization (Policies 2018 pp. 1-2), Mail and package delivery: the front desk will not handle mail or packages for off-site units; they may be refused or returned (Policies 2018 p. 1), In-room safe override/reprogramming by on-site staff costs $50, prepaid by the owner's credit card on a written request (Policies 2018 p. 2), No exclusion of pools, decks, spas, exercise room or elevators for off-site guests appears in any document on file; the pages of the 2022 Rules that would carry pool/amenity rules are missing
Wristbands & parking passesParking: the garage is for owners and guests only; one-bedroom units get 1 space, two-bedroom units 2 spaces; contractors on a temporary basis (text cut off) (Rules 2022 p. 1, PARKING). Garage spaces are not assigned; one additional vehicle may obtain a free overflow pass for designated lots across the street; all further vehicles are subject to parking fees, amount unstated (Policies 2018 p. 1). Guests give license plate number(s) at check-in (Policies 2018 p. 1). Campers, motor homes, jet skis, boats, recreational equipment and trailer-mounted catering equipment are unauthorized vehicles and may be towed and stored at the owner's expense without further notice (Rules 2022 p. 1). Master Deed: no automobile may be left unattended on the property for more than one week; motorcycles, trailers, campers, boats and watercraft are barred from the common elements unless the Board approves in advance; the Board may set absolute rules on non-standard vehicles and may tow (Art. XV p. 11; By-Laws Art. III Sec. 18(p) p. 63, Sec. 23(d) p. 66). Off-site vendors must park in the garage on the second floor or higher (Exhibit G p. 72). Wristbands or pool passes: unstated (the amenity pages of the 2022 Rules are missing). Under the hotel easement, use of the pools, decks, spas and exercise room by anyone is subject to rules the hotel owner and the Regime impose 'for the safety and identification of all persons using said Amenities' and to seasonal, weather and other closures decided by the hotel owner and the Board, so identification (wristband-style) rules and amenity closures can be set partly by the hotel (Master Deed Art. VI p. 6).
Check-inFront desk issues keys, but only after the owner registers each stay. The owner or a rental agent on file must email the reservation (owner name, unit, guest name, dates) to the on-site company's off-site desk in advance; at arrival the guest shows photo ID matching the name on file, signs for key pick-up, and gives a cell number and license plate(s); no keys are issued if the ID does not match the name the owner supplied (Policies 2018 p. 1). This sits on top of the Master Deed, under which front desk, reservations and key pick-up/drop-off are commercial activities reserved to the commercial unit and owners may not use any common element for the business of renting (Art. XIV pp. 10-11); the Exhibit F plaque tells guests not to make inquiries or complaints at the front desk (p. 71), and the 2018 Policies tell off-site guests to use the front desk for maintenance only in emergencies (p. 2). Vendors and other management companies must sign in/out at the front desk and pick up unit keys there each visit (Exhibit G p. 72; Policies 2018 p. 1).
TrashGuest and household trash goes only in the blue bins on the ground floor of the parking garage, not in corridor, hallway or garage trash cans or the trash chutes; furniture, appliances and construction materials must be removed from the property; violation may result in a fine to the unit owner (Policies 2018 p. 2). The 2022 Rules say trash must be secured in a heavy-duty plastic bag and deposited in the trailer on the ground floor, with discarded grills, furniture, appliances, screens and boxes taken to a dump off premises at the owner's expense (Rules 2022 p. 1, TRASH). Trash chutes and trash room are common elements (Master Deed Art. XXXVI(J) p. 32) but off-site housekeeping/maintenance companies may not use the chutes or corridor cans and must take all trash off the property, bagged, with no leaky bags in corridors (Exhibit G p. 72).
ElevatorsElevators are common elements open to owners and guests under the Article VII easement; no service-elevator-only rule appears in these documents. Luggage carts are for guest use only, not for trash, linens, chemicals, supplies or tools (Exhibit G p. 72; Policies 2018 p. 1). Move-ins and move-outs must be done during business hours and coordinated with building maintenance (Rules 2022 p. 1, TRASH).
Housekeeping & linenDaily or weekly maid service by independent contractors acting for owners is expressly permitted, but only the commercial unit owner may use the on-premises maid closets and linen chute (Master Deed Art. XIV p. 11). All housekeeping and maintenance personnel must have their name and company on file with the front desk (emailed authorization) before a key is issued, sign keys in and out on each visit, and wear a nametag with name and company (Policies 2018 p. 1). The on-site company provides no housekeeping, maintenance or supplies to off-site guests except in emergencies (Policies 2018 p. 1). Off-site cleaners may not use the on-site company's carts, vacuums, linens, chemicals or supplies, must label chemicals and supply MSDS to the property General Manager, and bag all linens (Exhibit G pp. 72-73). Off-site managers must notify the Grantor's company who performs cleaning (Art. XXXIX p. 34).

How much work lands on you?

Caution

What the rules make the owner personally responsible for: a local contact who answers in minutes, keys and passes, trash, fines for guest behaviour, vendor hours and elevators.

No local-agent, response-time or Association registration rule exists, but every booking must be emailed to the on-site desk with the guest's name and dates (and re-sent on any change) or the guest gets no key, owners or their agents handle all non-emergency maintenance because staff will not service off-site units, cleaners and handymen must be pre-authorized on file and sign keys in and out every visit under Exhibit G and 2018 Policy rules, owners may not alter the door or lock and may have to lodge a key at the desk, mail needs a PO Box, trash and move-in rules carry owner fines, owners are answerable for guests' conduct and damage, any off-site company must carry $1M/$2M insurance naming the HOA, fines become liens, and all owner claims go through mandatory negotiation, mediation and binding arbitration.

Local contactNo local-agent requirement is stated, but the on-site company keeps a file of 'Owners or Rental Agents' who alone may confirm reservations, and the owner or managing agent is the contact for every non-emergency maintenance issue a guest has, since on-site staff will not service off-site units (Policies 2018 pp. 1-2). The off-site company's phone number must appear on the Exhibit F plaque (file p. 71), and off-site vendors must report maintenance and safety issues to the on-site Director of Engineering (Exhibit G pp. 72-73). Owners must make all guests and rental agents aware of the policies and rules (Policies 2018 p. 1; Rules 2022 p. 1).
Response timeUnstated. No response-time rule appears in these documents.
Locks & keysKeys are issued by the front desk to guests whose name the owner has emailed in advance and who show matching photo ID; cleaners and maintenance people must be on file with the front desk before any key is issued and must sign keys in and out each visit (Policies 2018 p. 1). Owners may not make aesthetic or structural changes to the entry door or to any locking mechanism on it without the Association's written consent (Master Deed Art. XIX, file p. 13), which constrains smart-lock installs. If required by the Association, each owner must deposit a unit key under Association control at the front desk; if the owner fails to and entry is needed, the owner is charged the cost of making a key (Art. XVII p. 12; Art. XXI p. 15). Emergency entry rights extend to persons authorized by the owner 'including rental managers and their agents' (Art. XVII p. 12). In-room safes: most off-site owners do not give guests safe access; a malfunctioning safe can be overridden or reprogrammed by on-site staff for $50, prepaid by credit card on the owner's written (email) request (Policies 2018 p. 2).
FinesBoard may impose reasonable fines (which become a lien on the unit) and suspend voting and common-area use for violations; a fine for an occupant's violation is first assessed against the occupant, and if unpaid the owner pays on notice. Notice with at least 10 days to request a hearing before the Covenants Committee, appeal to the Board within 30 days; Board may also use self-help (including towing) or sue, with the owner/occupant paying costs and attorney's fees (By-Laws Art. III Sec. 23, file pp. 65-66). Each owner is responsible for the conduct of family, guests and service personnel and for any damage they cause (Rules 2022 p. 1, GENERAL). Waste-policy violations 'may result in a fine to the unit owner' (Policies 2018 p. 2). Unauthorized vehicles may be towed and stored at the owner's expense without further notice (Rules 2022 p. 1). Owners are liable for repair costs caused by their guests, agents or lessees to the extent not covered by Association insurance, including any increase in insurance rates (Master Deed Art. XXX(B) p. 28). No fine schedule is printed in any document on file (the later pages of the 2022 Rules are missing).
Contractors & vendorsPolicies 2018 (p. 1): housekeeping and maintenance personnel must have name and company on file with the front desk (authorization sent by email) before key issue, sign keys in and out each visit, wear a nametag with name and company, and not use luggage carts for supplies or trash. Rules 2022 (p. 1): all contractor debris must be cleaned up and removed from the property; move-ins/outs during business hours coordinated with building maintenance; contractors may park only on a temporary basis (rest of the rule missing). Exhibit G standards for off-site housekeeping and maintenance (file pp. 72-73): sign in/out and pick up keys at the front desk every visit; nametag at all times; park in the garage on the second floor or higher only; no trash chutes or corridor cans, haul all trash off property; all trash and linens bagged, no leaky bags or chemicals in corridors; chemicals labeled with MSDS filed with the property General Manager; no smoking or eating in corridors; no use of luggage carts for supplies; no use of the on-site company's carts, vacuums, linens or supplies; no personal belongings on property; report maintenance and safety problems to the on-site Director of Engineering; comply with building codes and OSHA. Off-site rental companies must also carry $1M/$2M GL naming the HOA, workers' comp with waiver, and a $15,000 dishonesty bond, and the HOA disclaims any loss to their property (Art. XXXIX p. 34).
AlsoEvery stay must be pre-registered by email with the on-site company's off-site desk (owner name, unit, guest name, dates) or the guest gets no key; last-minute guest-name changes have to reach the desk first (Policies 2018 p. 1). Off-site guests receive no housekeeping, maintenance or supplies from on-site staff except in emergencies, so the owner needs their own cleaner and handyman; staff may not enter an off-site unit without management authorization (Policies 2018 pp. 1-2). Owners and long-term guests need a PO Box or other mail service because the front desk refuses mail and packages for off-site units (Policies 2018 p. 1). Association or its contractor performs monthly pest control which may include spraying inside each unit (Master Deed Art. XVIII p. 12). Owner maintains and replaces HVAC, appliances, window glass and sliding-door glass, interior surfaces, and pays the portion of any insured loss that falls within the master policy deductible (Art. XXI pp. 14-15). Units are non-smoking and no pets are allowed, for owners and guests (Policies 2018 p. 1; Rules 2022 p. 1). No grills or cooking devices in units or on balconies, porches or hallways (Rules 2022 p. 1; Art. XIX p. 13); balcony furniture must be neutral colors, nothing hung from railings, no storage, no wall hangings or dishes (Rules 2022 p. 1); no satellite dishes or antennas, uniform white window-treatment backing, no exterior signs (Art. XIX p. 13). Unauthorized alterations must be removed within 30 days or the Association removes them at the owner's cost (p. 14). All owner disputes go through mandatory negotiation, mediation and binding arbitration with jury trial waived (Art. XXXVIII p. 33; Art. XL pp. 34-39). Exhibit B states that built-in kitchen appliances, counters, cabinets, refrigerators and the heating, ventilation and air-conditioning systems serving each residential unit are part of the unit, 'sold as is, where is', and are the owner's to maintain and replace (Exhibit B p. 42). An owner is liable for injuries or damage from an accident inside the unit to the same extent as the owner of a house, and may buy personal liability cover at own expense (Art. XXIII p. 16); the Association's blanket HO6 gives only $500,000 premises liability per unit (COI p. 2).

Is the money healthy?

Typical

Whether the association can pay for the building without surprise bills: reserves, special assessments, insurance deductibles, how fast dues are rising, and how much of the fee passes through to a master association.

The second copy of the 2026 budget confirms every figure: dues rose a modest 2.5%, bundle electricity, water, cable, pest control, security, parking and a blanket HO6, and the master policy carries a flat $25,000 wind deductible with a Lloyd's buyback, but insurance is about 28% of the budget and financed, the 2024 property premium was billed as a separate $379,500 'TBD' assessment on top of dues, reserve funding was cut 35% to 8.6% of budget beside a recurring $96,000 'reserve loan funding' line whose loan is unexplained, and no reserve study, balance sheet or delinquency report is supplied - typical-to-weak, so a 3.

2026 budget$1,636,163
Dues change+2.5% on the year
Reserves9% of budget
Special assessments2024 $379,500 total, marked 'TBD' pending actual renewal premiums; per-unit share not shown on the budget - about $3,888/yr ($324/mo) for a Type A1 unit at 1.0244% if allocated by percentage interest as Master Deed Art. XXVII(A) requires 2024 property insurance assessment billed separately from regular dues (Budget 2024, line 'Insurance Assessment - TBD billed separately'); by 2025 insurance was folded into the regular assessment

Insurer B Travelers Casualty & Surety Co of America, crime policy, 06/01/2025-06/01/2026, $1,000,000. HO6 Block Policy 6/1/2025-6/1/2026 covering every unit: 1-bedroom $20,000 total blanket limit (contents, loss of use, loss assessment, additions and alterations), 2-bedroom $25,000; $2,500 property deductible per claim; $500,000 premises liability; $1,000 medical payments; severability of liability applies. Budget: 2026 Insurance Expense $392,000 (24.0% of budget) plus HO6 Insurance Expense $64,000 (3.9%), together $456,000 or 27.9%; 2025 $387,200 + $55,000; 2024 $379,500 (billed as a separate assessment) + $65,149. The 2026 G&A section carries a line '55000 Interest Expense - Insur Financing', so premiums are financed. Master Deed Art. XXVII(B) allows insurance assessments to be levied annually in advance (p. 21). All 2025/2026 budget figures re-verified against the second copy of the 2026 budget (9dd79e10).
Wind deductible$25,000 Wind & Hail per occurrence (flat, not a percentage), supported by a Wind Deductible Buyback placed with Lloyd's of London; $25,000 all other perils per occurrence; $25,000 equipment breakdown per occurrence; 2% earthquake per occurrence (COI p. 2). Unit owners bear the portion of in-unit repairs that falls within the deductible (Master Deed Art. XXI p. 15).
FloodFlood carrier listed as American Bankers Ins. Co. of FL, 'See Following Dec Page' - the dec page is not in the supplied set, so flood limits and deductible are unstated (COI p. 2). Master Deed requires flood coverage 'if reasonably available' (Art. XXIV p. 17).
DelinquencyAssessments payable in installments set by the Board (monthly by default; a monthly installment is delinquent on the 15th unless the Board decides otherwise). On default the Board may accelerate the whole annual assessment on 10 days' notice; delinquent amounts bear 18% interest per annum; a $25 late fee applies to each installment more than 30 days late; after 20 days the Association may terminate utility service to the unit and pursue lien foreclosure (in the same manner as a mortgage) with a receiver and rental at Grand Strand market rates; owner is personally liable for collection costs and attorney's fees; a buyer at a voluntary sale is jointly liable for the seller's unpaid assessments (Master Deed Art. XXVII G-L, file pp. 22-25; By-Laws Art. III Sec. 20(f)(iv) p. 64). Delinquency report and current receivables are not supplied. The Master Deed imposes no resale capital contribution or transfer fee: the two-month capital contribution and one-year advance insurance assessment apply only to initial sales by the Grantor (Art. XXVII(C) p. 21). Principal and interest on Association borrowing is a common expense owners must fund (Art. XXXVI(G)(4) p. 31).

Who's really in charge?

Red flag

Who holds the power the documents hand out: an owner-elected board, or a developer or commercial-unit owner with deed-level rights over rentals, guest services and the building's name.

Developer control was required to end by 2017 and an owner Board is adopting and recording rules, but the commercial unit holds exactly what the guide's 1 describes - a deed-level, perpetual monopoly on rental management, reservations, front desk, key pick-up, concierge, in-unit communications and food/beverage within the regime that cannot be amended without Grantor consent and a unanimous owner vote - and the 2018 Policies show that monopoly in operation (the on-site company controls key issue to off-site guests, keeps the approved-agent and cleaner files, and bars its staff from off-site units), plus a guaranteed board seat with CU-1 power to remove any director to install one, Grantor written-consent rights over rules and amendments touching its reserved rights, prevailing-party fee-shifting and an arbitration carve-out to enforce the monopoly, and a perpetual hotel-guest easement over the pools that only the hotel owner can cancel.

StructureOne association
Commercial unitYes, with its own deed rights
On-site operatorHoliday Sands South Vacations, LLC ('HSSV') is named as 'the on-site rental management company' in the 2018 Policies & Procedures (p. 1); Master Deed Exhibit F (2007) named Holiday Sands South Properties, Inc. in that role (p. 71). HOA management: Ally Management, Inc. (2025 insurance certificate; Association incorporated c/o Ally Property Management, Exhibit D p. 52).
BoardThree to five directors, each with one vote; five directors after Class II (developer) control ended, elected by the members with staggered initial terms (two for 3 years, two for 2 years, one for 1 year) and two-year terms thereafter, no term limits. At least one director must at all times be an owner of a commercial unit, and if none is, the CU-1 owner may remove any sitting director and substitute a commercial-unit owner. Directors are removable with or without cause by majority vote of the membership; the Board may remove a director with three consecutive unexcused absences or more than 30 days delinquent. Officers (President, VP, Secretary, Treasurer) are elected annually by the Board from its members. Board meetings are open to members; at least two per year (By-Laws Art. III Secs. 1-16, file pp. 57-61; Art. IV p. 66). Directors receive no compensation unless a member majority approves (Sec. 14 p. 61). The Board may appoint a Covenants Committee of five to seven members as the hearing tribunal for fines (By-Laws Art. V Sec. 2 p. 67). The Board adopted Rules and Regulations in April 2022 and recorded them (Rules 2022 p. 1).
Developer rightsGrantor (Holiday Sands Ocean Front Resort, Inc.) held Class II membership with four votes per unit owned and a veto over all Board and committee actions, and could appoint a majority of the Board, all terminating no later than July 1, 2017 (By-Laws Art. II Sec. 2 p. 55; Art. III Secs. 2-3 pp. 57-58; Master Deed Art. XXXII p. 29, 'no later than May 2017'). While the Grantor owns any unit it also has 'the absolute right to lease or sell any such UNIT ... upon any terms and conditions as it shall deem to be in its own best interest', i.e. the advertising and off-site-manager rules of Art. XXXIX never bind the Grantor's own rentals (Art. XXXII p. 29). Surviving perpetual Grantor rights: written consent required for any rule that affects the commercial unit or Grantor-reserved rights (Art. XV p. 11), for amending the Article XIV commercial restriction (p. 11), Article XXII maintenance provisions (p. 15), any provision reserving a Grantor right (Art. XXIX pp. 26-27; By-Laws Art. VI Sec. 6 p. 69), and for any timeshare plan (Art. XIV p. 10); the Grantor's chosen rental company is the 'official' agency and is exempt from the advertising ban (Art. XXXIX p. 33); the Grantor or an affiliate may be hired as managing agent (By-Laws Art. III Sec. 19 p. 63); Grantor representatives need not recuse on Grantor contracts (Art. XXXII p. 29); Grantor may unilaterally amend for scrivener errors or lender requirements (Art. XXIX p. 27); Grantor holds a perpetual utility/communications easement over the common elements without Association consent (Art. VIII pp. 7-8). Whether the Grantor still owns units or has formally terminated Class II is not shown in the supplied documents; the Board's own 2022 Rules and the 2018 Policies suggest an operating owner Board but do not say so. Any contract, lease or management contract signed during Class II control binds the Association only if terminable by either party without penalty on no more than 90 days' notice (By-Laws Art. III Sec. 22 p. 65).
Commercial-unit rightsCommercial units CU-1 and CU-2 (about 3.6% combined interest) hold deed-level exclusive rights to: all commercial activity within the regime, specifically general rental management, reservations, key pick-up and drop-off, front desk, concierge, cable/movie/internet/wireless/telephone service to units, shops, vending, guest laundries, restaurant, lounge, health spa, real estate sales, cell towers (Master Deed Art. XIV p. 10; Art. XXXVI(B) p. 31); exclusive food and beverage sales on the common elements and pool decks (Exhibit B p. 43); a perpetual exclusive signage and advertising easement over corridors, elevators and the building exterior plus control of movable signs (Art. VI p. 6; Exhibit B p. 43); maid rooms on every floor, vending rooms, roof cell-tower space and other limited common areas (Exhibit B pp. 42-44); exclusive use of maid closets and linen chute (Art. XIV p. 11); the right to alter non-structural components of the commercial unit without Board consent (Art. XIX p. 13); the right to install exterior receiving/transmitting devices (p. 13); a guaranteed Board seat with CU-1 power to swap a director in (By-Laws Art. III Secs. 1, 6, 8 pp. 57-60); eligibility to be paid for landscaping and janitorial work for the Association (By-Laws Art. III Sec. 18(s) p. 63); the right to specifically enforce Article XIV against the Association and owners with prevailing-party attorney's fees, exempt from the mandatory arbitration regime (Art. XXX(C),(F) p. 28; Art. XL(A)(2)(v) p. 35); and consent rights over any amendment touching commercial-unit rights or any timeshare plan (Art. XXIX p. 26; Art. XIV p. 10). In practice the on-site company (Holiday Sands South Vacations, LLC per the 2018 Policies; Holiday Sands South Properties, Inc. per 2007 Exhibit F) runs the front desk that issues keys to off-site guests only after owner registration, keeps the file of approved owners/rental agents and cleaners, refuses mail for off-site units, charges $50 for safe service, and bars its employees from entering off-site units without management authorization (Policies 2018 pp. 1-2). The Board may also enter common-management or cost-sharing agreements with nearby hotels or condominiums (two-thirds of directors) and may assume maintenance of, or grant easements over, property for payment by non-members (By-Laws Art. III Sec. 22 p. 65; Master Deed Art. XX p. 14 contemplates amenities whose access and cost are shared with nearby hotels).
VotesOne vote per unit, weighted by the unit's percentage interest in the common elements (Exhibit C); co-owners designate one Voting Member; proxies allowed; quorum is 51% of the total vote; 'majority' means more than 50%; special meetings may be called by petition of 10% of the votes; action by unanimous written consent permitted (By-Laws Art. II Secs. 1-14, file pp. 54-57). Class II (Grantor) had four votes per unit owned until no later than July 1, 2017 (p. 55).
Changing the deedMaster Deed: proposed by a Board majority or members owning a majority of units, then approved at a special meeting by an affirmative vote of 67% of the members owning a unit, recorded within 30 days (Art. XXIX, file pp. 26-27). Exceptions: changes to percentage interests or the basis of assessments need all owners and all mortgagees; Grantor-reserved rights need the Grantor's written consent; commercial-unit rights need written consent of the Grantor and all commercial unit owners; the Article XIV commercial restriction needs Grantor consent plus a unanimous owner vote (p. 11); Article XXII needs Grantor consent (p. 15); mortgagee rights need all mortgagees (p. 27). By-Laws: 67% of the total votes including 67% of non-Grantor votes, Grantor consent for Grantor-reserved provisions, effective on recording (By-Laws Art. VI Sec. 6 p. 69). Rules and regulations: made and amended by the Board (By-Laws Art. III Sec. 18(f) p. 62). Termination of the regime requires unanimous owners and all lienholders (Art. XXVIII p. 25).
Disputes or lawsuitsNo pending litigation is mentioned (minutes not supplied). The Master Deed is headed with a binding, irrevocable arbitration notice (pp. 1-2); Article XL imposes mandatory written notice, negotiation, mediation (claim waived if not submitted within 30 days after negotiations end) and final binding arbitration under the South Carolina Uniform Arbitration Act for all claims among the Grantor, owners, Association and contractors, with loser-pays shifting of post-mediation costs; exempt claims include Association collection suits and the commercial unit owner's suits to enforce Article XIV (pp. 34-39). Article XXXVIII waives jury trial for all owners (p. 33). The Association indemnifies directors and officers to the fullest extent permitted by law (By-Laws Art. VII p. 69). Arbitration hearings are held at the Regime in Myrtle Beach, with no stenographic record and no post-hearing briefs, and the award is due within 14 days of the hearing (Art. XL(C) pp. 37-39).

03 Pros and cons

For the owner who runs it themselves.

The same building reads very differently to an owner on the rental program and an owner on Airbnb. This list is for the second one.

Working for you

  • The Master Deed expressly preserves every owner's right to rent or lease the unit and states no minimum stay, no owner-use cap and no requirement to use the on-site program (Master Deed, Art. XIV, file p. 10).
  • Off-site rental management companies and independent daily/weekly cleaners are expressly contemplated and permitted, and the 2018 Policies are addressed to 'OFFSITE MANAGERS, OWNER-MANAGERS, AND PERMANENT RESIDENTS', so Airbnb/VRBO self-management or a third-party manager is a recognized path, not a loophole (Master Deed, Art. XIV p. 11; Art. XXXIX pp. 33-34; Policies 2018 p. 1).
  • The on-site front desk does issue keys to your guests: once you email the reservation in advance, the guest checks in at the desk with photo ID, signs for the key and leaves a cell number and plate, which is front-desk-style arrival rather than lockbox hunting (Policies 2018, p. 1, Confirm Your Reservation and Guest Check-In & Stay).
  • Guests of any owner have the same perpetual easement over all common elements (pools, decks, spas, exercise room, elevators) as owners, and both owners and their guests also get reciprocal use of the adjacent Holiday Sands South Hotel's pools, decks, spas, exercise room and other general amenities; the 2018 Policies say off-site guests 'will be treated with the same courtesy as our own guests' and no document on file excludes them from any amenity (Master Deed, Art. VI p. 6; Art. VII p. 7; Policies 2018 p. 1).
  • The 2018 Policies allow 'photos of the interior of their own unit' in owner advertising, a practical softening of the deed's blanket picture ban, though the deed text still controls and the exterior/amenity ban and name ban remain (Policies 2018, p. 2, Advertising).
  • Parking is clearly allotted in writing: one garage space per one-bedroom unit, two per two-bedroom unit, plus one free overflow pass for lots across the street for a third car (Rules 2022 p. 1, PARKING; Policies 2018 p. 1, Parking).
  • Developer (Class II) voting, veto and board-appointment rights were required to end no later than July 1, 2017, so the five-member board should now be owner-elected for two-year terms (the Board itself adopted and recorded Rules in 2022, but no document confirms the hand-over) and removable by a majority of the membership (By-Laws, Art. II Sec. 2 p. 55; Art. III Secs. 6-7 p. 59; Rules 2022 p. 1).
  • Dues bundle an unusual amount: in-unit electricity (units are commonly metered), water/sewer, cable TV, unit phone, interior pest control and termite bond, an HVAC maintenance contract line (scope unstated), security patrol, and a blanket HO6 policy giving every unit $20,000-$25,000 of contents/loss-of-use/loss-assessment cover and $500,000 premises liability (Master Deed Art. XXVII(J) p. 24; 2026 Budget p. 1; COI p. 2).
  • The master property policy is strong for an oceanfront tower: $30,088,600 building, special form with wind/hail, earthquake, equipment breakdown and ordinance-or-law, replacement cost, agreed value, nil coinsurance, and a flat $25,000 wind/hail deductible backed by a Lloyd's wind-deductible buyback rather than a percentage deductible (COI pp. 1-2).
  • Regular assessment revenue rose only 2.5% from 2025 to 2026 (total budget +4.1%), and per-unit monthly dues rose $22-$36; the figures are confirmed by a second copy of the 2026 budget (2026 Budget p. 1, both copies).
  • Audited annual financial statements by an independent CPA, quarterly income/variance/balance/delinquency reports, and member inspection rights over books, minutes and the membership register are mandated (By-Laws, Art. III Sec. 20 p. 64; Art. VI Sec. 4 p. 68).
  • Management contracts are capped at one year and must be terminable on 90 days' notice; the Board may not borrow more than 5% of budgeted expenses for amenity upgrades without a member majority (By-Laws, Art. III Secs. 19 and 21 pp. 63-65).
  • Fines for guest violations are first assessed against the occupant, and the owner pays only if the occupant does not; the Board cannot bar ingress/egress to a unit (By-Laws, Art. III Sec. 23 p. 65).
  • Emergency entry rights are extended to the owner's own 'rental managers and their agents', and the Association maintains balcony floors, railings and balcony-facing walls as a common expense (Master Deed, Art. XVII p. 12; Art. XXI p. 15).
  • The regime is single-tier with no master-association pass-through; the commercial units pay dues on their own 2.91% and 0.72% interests (Master Deed, Exhibit C p. 48; 2026 Budget p. 1).
  • No resale capital contribution or transfer fee is imposed by the Master Deed; the two-month capital contribution and one-year advance insurance assessment apply only to initial sales by the Grantor (Master Deed, Art. XXVII(C), file p. 21).
  • The Board must make current copies of the Master Deed, Articles, By-Laws, rules and all books, records and financial statements available to any prospective purchaser, and directors may not be paid without a member-majority vote (By-Laws, Art. III Sec. 18(m) p. 63; Sec. 14 p. 61).
  • Every annual budget must include a replacement reserve and a general operating reserve by deed, and the Association's lien is subordinate to any earlier-recorded mortgage (Master Deed, Art. XXVII(D)-(E) pp. 21-22; Art. XXVII(K) p. 24).

Watch-outs

  • Advertising ban: no owner or agent may use any photo, rendering or model of the exterior, amenities or common areas, nor the name 'Holiday Sands' or 'Holiday Sands South', in any rental ad; the deed itself also bans interior pictures and allows only the recorded floor plans, while the Grantor's designated rental company is exempt. The 2018 Policies permit interior photos of your own unit, but that is a policy reading, not a deed amendment. A competitive Airbnb/VRBO listing is very hard to build (Master Deed, Art. XXXIX, file p. 33; Policies 2018 p. 2).
  • Every stay must be pre-registered: you (or a rental agent the on-site company has on file) must email the owner name, unit, guest name and dates to the on-site company's off-site desk before arrival, and the desk issues keys only to the person named, with matching photo ID, signature, cell number and license plate. Instant-book name changes, early arrivals and walk-ups all have to go through the desk first (Policies 2018, p. 1, Confirm Your Reservation and Guest Check-In & Stay).
  • Off-site guests get nothing from on-site staff beyond the key: no housekeeping, maintenance or supplies except in an emergency or a threat to the building, non-emergency problems go to you or your agent, on-site employees may not enter an off-site unit without management authorization, and the front desk refuses mail and packages for off-site units (Policies 2018, pp. 1-2, Off-Site Rentals, Mail and the maintenance paragraph).
  • The Exhibit F plaque telling guests the on-site company and front desk are not responsible for cleaning, maintenance or linens must be posted in the kitchen and inside the door of 'any unit not managed by Holiday Sands South Vacations', which the 2018 Policies read to include self-managed units, not just off-site companies (Policies 2018, p. 2, Notification; Master Deed Exhibit F p. 71).
  • Deed-level monopoly: rental management, reservations, key pick-up/drop-off, front desk, concierge, in-unit cable/internet/phone service and food/beverage sales within the regime are reserved exclusively to the commercial unit; owners may rent but may not use any common element 'to engage in the business of renting'. Changing this needs the Grantor's consent plus a unanimous owner vote; whether an owner may buy in-unit internet from an outside provider is not stated (Master Deed, Art. XIV pp. 10-11; Art. VIII pp. 7-8).
  • Any off-site manager must advertise in bold that it is not the official company, post the Exhibit F plaque, carry $1M/$2M general liability naming the HOA plus workers' comp and a $15,000 bond, tell the Grantor's company who cleans, and accept HOA inspection of the units it rents (Master Deed, Art. XXXIX pp. 33-34; Exhibit F p. 71).
  • Your cleaners and handymen must be pre-authorized by email and on file with the front desk before any key is issued, sign keys in and out every visit, wear nametags, park on the 2nd garage level or higher, stay out of the maid closets, linen chute and the on-site company's carts and linens, and haul trash off property or to the ground-floor bins; contractor debris must leave the property and move-ins/outs happen only in business hours coordinated with building maintenance (Policies 2018 p. 1; Master Deed Art. XIV p. 11; Exhibit G pp. 72-73; Rules 2022 p. 1, TRASH).
  • Trash discipline falls on your guests: household waste only in the blue bins on the ground floor of the garage (the 2022 Rules say a trailer on the ground floor), never in chutes or corridor/garage cans, and 'Violation of this policy may result in a fine to the unit owner'; bulky items go to a dump off-site at the owner's expense (Policies 2018 p. 2, Waste Removal; Rules 2022 p. 1, TRASH).
  • No changes to the entry door or its locking mechanism without Association consent, and the Association may require a unit key to be held at the front desk, so keypad/smart-lock self check-in needs approval; the on-site company's key-issue process is the only documented arrival path, and a jammed safe costs $50 prepaid by your credit card on an emailed request (Master Deed, Art. XIX p. 13; Art. XVII p. 12; Policies 2018 p. 2, Safes).
  • You are answerable for your guests: each owner is responsible for the conduct of family, guests and service personnel and for any damage they cause, and must ensure the rental agent and guests understand the rules; fines unpaid by an occupant fall to the owner and become a lien (Rules 2022 p. 1, GENERAL; By-Laws Art. III Sec. 23 p. 65).
  • Guest-facing lifestyle rules are strict: units are non-smoking and smoking is banned on balconies and in common areas, no pets of any kind, no grills or cooking devices in units or on balconies, porches or hallways, no fireworks, occupancy capped at the legal limit, excessive noise after 11:00 PM is a violation, nothing hung from balcony railings, neutral balcony furniture only, no boats, jet skis, campers or motor homes (towed at owner's expense), no car left unattended over one week, monthly in-unit pest spraying, white window backing (Rules 2022 p. 1; Policies 2018 p. 1; Master Deed Art. XV p. 11; Art. XVIII p. 12; Art. XIX p. 13).
  • Parking is capped at one garage space for a one-bedroom unit and two for a two-bedroom unit, with one free overflow pass across the street and 'parking fees' (amount unstated) for any further vehicle; the recorded Rules text on file breaks off mid-sentence in the PARKING section, so contractor parking, pool/amenity rules, wristbands and the fine schedule are unknown (Rules 2022 p. 1, PARKING; Policies 2018 p. 1, Parking).
  • The adjacent Holiday Sands South Hotel's guests hold a perpetual, exclusive, commercially useable easement over the regime's pools, decks, spas and exercise room, which only the hotel owner can cancel; expect pool crowding and shared-amenity rules set partly by the hotel (Master Deed, Art. VI p. 6).
  • Commercial-unit influence over governance is permanent: at least one director must be a commercial-unit owner and CU-1 can remove any director to install one; rules affecting the commercial unit bind only with the Grantor's written consent; the Grantor or an affiliate may be hired as manager; CU-1 may be paid for landscaping and janitorial work (By-Laws, Art. III Secs. 1, 6, 18(s), 19 pp. 57-63; Master Deed Art. XV p. 11).
  • The commercial unit owner can specifically enforce Article XIV against owners with prevailing-party attorney's fees and is exempt from arbitration for that claim, while owners' own claims must go through mandatory negotiation, mediation and binding arbitration with jury trial waived and claims forfeited if deadlines are missed (Master Deed, Art. XXX(F) p. 28; Art. XXXVIII p. 33; Art. XL pp. 34-39).
  • Insurance is about 28% of the 2026 budget ($392,000 property plus $64,000 HO6), premiums are financed (an 'Interest Expense - Insur Financing' line), and in 2024 the $379,500 property premium was billed as a separate 'TBD' assessment on top of dues; Article XXVII allows insurance assessments to be levied annually in advance (2024 Budget p. 1; 2026 Budget p. 1; Master Deed Art. XXVII(B) p. 21).
  • Reserve funding was cut from $215,000 (2025) to $140,000 (2026), only 8.6% of the budget, while a separate $96,000 'General Reserve Loan Funding' line recurs every year (2024-2026), suggesting debt tied to reserves; no reserve study, reserve balance or loan terms are supplied even though the Master Deed requires a replacement reserve and an operating reserve in every budget, recommends periodic engineering studies, and makes principal and interest on Association loans a common expense (2026 Budget p. 1; Master Deed Art. XXVII(D)-(E) pp. 21-22; Art. XXXVI(G)(4) p. 31).
  • Repairs & Maintenance jumped 27% ($398,225 to $505,355) in 2026, and the budget now carries an HVAC maintenance contract line that was absent in 2024; G&A rose 18% (2026 Budget p. 1).
  • Owners bear the portion of any in-unit insured loss that falls within the master policy's $25,000 per-occurrence deductible (and the HO6's $2,500), plus full responsibility for HVAC, appliances, window and slider glass (Master Deed, Art. XXI pp. 14-15; COI p. 2).
  • Flood coverage is only referenced ('American Bankers Ins. Co. of FL: See Following Dec Page'); limits and deductible are not in the supplied set (COI p. 2).
  • Harsh delinquency terms: acceleration of the full annual assessment, 18% interest, $25 late fee, utility shut-off after 20 days, lien foreclosure with a receiver collecting market rent, and a buyer at a voluntary sale is jointly liable for the seller's arrears (Master Deed, Art. XXVII(G)-(L) pp. 22-25).
  • The HOA's own budget pays for 'Front Desk Services' and 'Security Reimbursement Allocation' lines, and that front desk is the one the on-site company runs, issuing keys to off-site guests only after registration and refusing their mail; who the HOA-funded front desk serves and on what terms is not explained (2026 Budget p. 1; Master Deed Exhibit F p. 71; Policies 2018 pp. 1-2).
  • The hotel owner, jointly with the Regime, may impose identification rules on everyone using the pools, decks, spas and exercise room and may close those amenities for seasonal, weather or other 'reasonable' reasons, so your guests' amenity access is partly in a third party's hands (Master Deed, Art. VI, file p. 6).
  • You carry homeowner-style liability for accidents inside your unit, and the only liability cover the dues buy is the blanket HO6's $500,000 premises liability per unit, so a self-managing host needs separate short-term-rental liability insurance (Master Deed, Art. XXIII p. 16; COI p. 2).
  • In-unit HVAC, appliances, counters and cabinets are deed-designated 'as is, where is' owner items, and the HOA-paid 'HVAC Maintenance Contract' line does not say whether it reaches inside units (Master Deed, Exhibit B p. 42; 2026 Budget p. 1).
  • The on-site rental company has changed name since the deed: Exhibit F (2007) names Holiday Sands South Properties, Inc., the 2018 Policies name Holiday Sands South Vacations, LLC; the Exhibit F plaque wording and the identity of the Grantor's current 'designated' company should be confirmed before printing plaques or signing with an off-site manager (Master Deed Exhibit F p. 71; Policies 2018 pp. 1-2).
04 The money

What you pay, and where it goes.

An HOA fee is a share of a budget. The budget tells you whether the fee is buying upkeep or catching up on it.

06 Before you write an offer

What to ask the association for.

The documents we had leave these open. Ask for them in the due-diligence period and the score firms up.

Documents read October 2026. Full read: Deed, rules and the money were all on file.

Read this before relying on anything aboveEvery statement on these pages is read from the association's own recorded documents, named on the page, as they stood on the date shown. Boards amend rules, budgets change every year, and a recorded amendment can change a score overnight. Confirm anything you would rely on with the association or your closing attorney before you write an offer. This is not legal, tax or investment advice.
The next step

Have the documents read
for the building you are weighing.

This page says what the association's documents allow, require and cost. It cannot tell you which unit is listed this week, or what the seller's estoppel will say. Tell us the resort and we will read its documents against this framework, or pull them if you are under contract.

We use the numbers on this page to answer you specifically. No list, no drip sequence — a person reads it.
