What the documents decide
before your first guest books.

Five dots is the best answer for an owner who wants to run the unit themselves. One dot is a red flag. Open “What the documents say” under each for the exact words.

01

Can you rent it your way?

Favorable

Whether the deed and rules let you rent short-term on your own terms: no requirement to use the on-site program, no minimum stay that kills weekend bookings, and no rule against saying where the condo is.

Short-term renting is expressly allowed with no minimum stay, no on-site program and any manager, but owners must register their rental agent with management, accept a 23+ occupant rule for stays under 90 days set at master-association level, and are liable for all tenant fines.

Short-term rentalsAllowed
Must use on-site programNo
Owner may rent it personallyYes
Off-site manager allowedYes
Owner-use limitsNone stated. Units must be used for residential purposes; leasing for residential purposes is expressly not a 'business' (Rules Art. II Sec. 1). Occupancy capped at the number of heads of household and family permitted by county/state zoning.
RegistrationOwners must give Management (FirstService Residential) the name and contact information for their rental agent and are responsible for the rental company's compliance and for timely damage notification (Rules Art. V(c)). Service and emotional-support animals need an HOA registration form filed 30 days in advance (short-term rentals do not qualify for an ESA). Utility-trailer parking requests go to Management before arrival so the master-association security gate is notified. No general guest/tenant registration form, decal or pass requirement appears in these documents (master association pass rules are not in the set).
Advertising rulesOnly one 3 x 4 inch professionally designed 'For Rent' sign in a lower corner of the interior hallway window (Rules Art. II Sec. 17(a)); otherwise no signs on the building, common areas or any part of a unit visible from the exterior. Master Deed Art. XII(C)(4) and By-Laws Art. XII Sec. 11 bar advertisements/posters on the property except as authorized. No restriction on using the resort name or photos is stated.
Vote to change rental rulesMaster Deed: affirmative vote of 67 percent of all voting members (Art. VI); By-Laws: 67 percent of the total vote (Art. XX). Rules and Regulations (including the leasing article and fine policy) can be changed by the Board alone on 30 days' written notice (Rules Preamble, Art. XII Sec. 1). The lease age rules also sit in the master association's Declaration (Sec. 6.8), which its board amended by unanimous board resolution in 1998.

Will your guests be treated like guests?

Typical

Whether a guest who booked through you gets the same resort as a guest who booked through the front desk: the same pools, parking, wristbands and check-in, or a second-class version of them.

Off-program guests get full amenity parity with no amenity fees, but there is no front desk, owners handle keys through HOA master-keyed locks and HOA lockboxes, guests face master-association gate fees for trailers and no-pet/no-ESA rules, and the master association's pass rules are not in the set.

Amenities for your guestsSame as program guests
Wristbands & parking passesNo wristband, decal or pass system is described in these documents. The 1982 deed lets the Board require permission and a fee for guest use of common elements, but the 2022 rules prohibit any amenity fee for pools, the lazy river or other common elements. Parking: at least one space per apartment (Master Deed Art. III Sec. 4); motorcycles only in designated areas west of the A Building; rental guests may bring motorcycle trailers only during official Bike Weeks and pay an entry fee at the master-association security gate; guests may never park or store a utility trailer; no long-term vehicle storage. The 2026 budget shows $125,000 'Gate fee agreement' income, terms unstated. The rules state that Article IX of the master association's Declaration gives this regime's Board 'the sole authority to determine any fees and assessments within the boundaries of the PROPERTY' (Rules Art. VIII Sec. 1), so master-level fees (gate, decals, passes) would apply outside the A Building parcel; those master rules are not in the set.
Check-inunstated (no front desk or check-in procedure is described; the HOA sells lockboxes for hallway doors, implying owner/agent-handled key exchange)
TrashGuests must bag refuse in secured heavy-duty plastic bags and use the on-property dumpsters; nothing may be left on balconies or around/inside the trash enclosure; bulky items go off-site at the owner's expense; damage to common elements from trash removal by owner, guests or contractor is charged to the owner (Rules Art. II Sec. 14).
ElevatorsElevators are common elements (Exhibit 1); no service-elevator or move-in rule is stated.
Housekeeping & linenunstated (no housekeeping, linen or inspection rules appear in these documents)

How much work lands on you?

Typical

What the rules make the owner personally responsible for: a local contact who answers in minutes, keys and passes, trash, fines for guest behaviour, vendor hours and elevators.

Normal hosting plus rental-agent registration, master-key-system locks and HOA-only lockboxes, strict contractor licensing/insurance/hours rules, owner liability for tenant fines up to $1,500 a year and posting rules in the unit; no 30-minute response rule or owner trash hauling.

Local contactunstated as a general requirement; owners must give Management the name and contact information of their rental agent (Rules Art. V(c)).
Locks & keysAll deadbolts and locks must be keyed to the MBR HPR Association master maintenance key system using the HOA-approved locksmith; no owner or tenant may alter or install locks without giving the Association access; the Board or its agent may retain a key; a lockbox may be installed on the hallway door only if purchased from and installed by the HOA (Rules Art. II Sec. 6(c)-(d), Sec. 19). Hallway doors may carry only a peephole, a wireless doorbell switch, the standard HOA non-smoking sign and the HOA lockbox (Rules Art. II Sec. 6(c)); the Board may enter the unit with its retained key for maintenance, inspection, pest control or emergencies (Sec. 19; Master Deed Art. XII(C)(3)).
FinesExhibit A fine policy: general violations up to $100 per day or per occurrence; pet/animal violations $100 per occurrence and unapproved emotional-support animal $50 per day; health and safety violations (fireworks, throwing items from balconies, trash attracting pests, glass at the pool, flood/fire threat) up to $500 per occurrence; maximum annual fine $1,500. Owner gets written notice and 15 days to request a Board hearing. Owners are ultimately responsible for tenant fines and for all enforcement costs including attorneys' fees; amenity privileges can be suspended up to 30 days; the deed lets the Board bar a non-compliant renter from the property and lien the unit for removal costs.
Contractors & vendorsBefore any contractor works inside a unit the owner must give the Association proof of a valid contractor/specialty license plus certificates of liability and workers' compensation insurance; contractors must wear ID, display a parking permit and remove debris by 6:00 p.m. daily; work hours 8:00 a.m.-5:00 p.m. Monday-Saturday, no Sunday work; owners may not hire contractors to touch common elements. Interior wall, plumbing or electrical changes need written Association approval (Rules Art. III). Any exterior addition, change or alteration (expressly including exterior color changes, screen doors, storm windows and storm doors) needs prior written MASTER ASSOCIATION approval submitted through Management (Rules Art. III). Replacement exterior doors are approved by the regime's Board and must be bronze aluminum/vinyl/composite hurricane-rated (Rules Art. II Sec. 7(a)); professional black bedroom-window tint and heat-control sliding-door tint are permitted without separate approval (Sec. 6(b), 7(b)). Window treatments need uniform black or white backing (interior) / white backing (exterior).
AlsoNo washers or dryers may be installed in any unit (existing ones grandfathered only if registered by October 2, 2022 and must be removed at sale). Hot water heaters must be replaced at end of useful life (recommended every 10 years) at owner expense. Owner must maintain HVAC, water heater, appliances, interior plumbing/electrical, doors, windows and glass (Master Deed Art. XII(C)). Rules must be posted in the unit and tenants told they are subject to fines. Pets prohibited for owners, guests and tenants (grandfathered existing animals only); service/ESA animals need 30-day advance registration and short-term rentals do not qualify for an ESA. Balcony limits: two non-metallic drying racks distributed by the Association, one non-metallic storage cabinet, outdoor-rated furniture below railing height. Quiet hours 11 p.m.-7 a.m. Drones, fireworks, grilling outside Association grills, skates/scooters/hoverboards/mopeds prohibited.

Is the money healthy?

Typical

Whether the association can pay for the building without surprise bills: reserves, special assessments, insurance deductibles, how fast dues are rising, and how much of the fee passes through to a master association.

Reserves funded at about 15.6% of budget and dues fell 4.3% with no special assessment shown, but insurance is 37% of the budget billed as a separate assessment with unstated deductibles, a 19.5% opaque master-association pass-through, a 42% jump in maintenance staff cost and no reserve balance or financials supplied.

2026 budget$2,243,587
Dues change-4.3% on the year
Reserves16% of budget
Special assessmentsNone in the documents
InsuranceInsurance is budgeted at $835,000 for 2026 (down 9.7% from $925,000 in 2025) and is recovered through a separate 'Insurance Assess' income line of the same amount, consistent with Master Deed Art. X Sec. 3 which makes premiums a common expense paid separately each month by each Co-Owner to the Insurance Trustee (Capital Acceptance Corporation was appointed in 1982). The deed also lets the Insurance Trustee assess owners for a self-insurance fund to cover deductibles. Liability coverage of at least $500,000 per occurrence is required (Art. X Sec. 12). The Hazard rule (Rules Art. II Sec. 20) bars anything that raises the rate or cancels the policy. The deed expressly preserves each owner's right to insure his own apartment for his own account (Art. X Sec. 8) but states no HO-6 requirement. Deductible amounts, carrier and policy limits are unstated.
FloodMaster Deed Art. X Sec. 1 requires the Board to insure the whole property (common elements and apartments) against fire, earthquake, flood, vandalism and the elements (windstorm, etc.) for full replacement; whether a separate flood policy is in force today is unstated.
Passes through to a master association20% of the budget
DelinquencyAssessments due the first of each month; a late charge of the greater of $10 or 10 percent of the amount due after 10 days (Master Deed Art. IX; By-Laws Art. XII Sec. 2); lien on the unit foreclosable like a mortgage with attorneys' fees and collection costs; delinquent owners and their lessees/guests are refused entrance to the regime and use of the facilities until paid (By-Laws Art. XII Sec. 5; Master Deed Art. III Sec. 3). 2026 budget carries $2,445 Late Fees/NSF income and $7,500 Uncollectible Assoc. expense (2025: $3,500 and $10,000).

Who's really in charge?

Typical

Who holds the power the documents hand out: an owner-elected board, or a developer or commercial-unit owner with deed-level rights over rentals, guest services and the building's name.

Owner-elected seven-member board, 67% amendment threshold and no commercial unit or rental-desk monopoly, but the regime is 'subordinate to' a master association (gate, exterior approvals, 19.5% of the budget) whose documents are not in the set, and the deed keeps un-amendable Declarant/'Present Owner' rights over Resort Facilities and easements that have no sunset (the Art. XV rights lapse once the Declarant owns no unit; current holder unstated).

StructureTwo tiers: a master association above this one
Master associationThe Myrtle Beach Resort Homeowners' Association, Inc. (MPOA)
Commercial unitNone
BoardSeven-member Board of Directors elected by the owners at the annual meeting (first quarter of the year) for staggered two-year terms, no cumulative voting; directors must be owners in good standing and lose their seat if delinquent; officers elected from the Board annually and serve without pay; Board meets at least quarterly; a 2/3 Board vote can declare an annual-meeting quorum with only 1/3 of votes present (By-Laws Art. VIII-XI). The initial three-member Declarant board was to hand over within nine months of the 1982 recording (Master Deed Art. II Sec. 4).
Developer rightsResort Investment Corporation (Delaware) reserved, while it owns any apartment: the right to sell/lease its units free of restrictions; exclusive right to contract for water, sewer, utility, telephone and television services binding on the association; the right to enter other agreements binding on owners; use of common elements and any apartment for sales, rental, management, model, laundry or maintenance offices and signs; a right to annex Phases II-III by sole action (deadlines April 1984 and June 1985); the right to grant easements and licenses to use the beach and amenities to outside parties for a fee; and 'Resort Facilities' control with owners paying 'Resort Expenses' to the Declarant (Master Deed Art. XI, XIV, XV, XVIII). No amendment may change Declarant rights without its written consent (Art. VI, VII), and a construction mortgagee inherits all Declarant rights on foreclosure (Art. XVI). Important limit: the Article XV rights (free sale/lease of its units, exclusive utility/TV/phone contracting, binding agreements, sales/rental/management office use) apply only 'so long as the Declarant continues to own any of the Apartments' (Art. XV Sec. 1), and the Declarant's architectural veto likewise lasts only while it owns an apartment (Art. IV); the easement-granting rights (Art. XIV), the beach/amenity licenses to outside users for fees (Art. XIX(J)) and the Resort Facilities/Resort Expenses regime (Art. XVIII, which also names a 'Present Owner' of the balance of the 44.62-acre tract) carry no such sunset. Art. XI also provides that nothing restricts the Declarant 'or any successor interest' from conveying apartments under a time-sharing or interval-ownership plan. Whether the Declarant or any successor still owns an apartment or exercises any of these rights in 2026 is unstated.
Commercial-unit rightsNo commercial unit exists in this regime as constituted (the 4 commercial units and convention-center apartment belonged to unbuilt Phases II-III, Exhibit 2). Master Deed Art. XI permits only Declarant model/management/sales/rental offices and commercial laundry and vending equipment; the 2026 budget shows the association itself earning Laundry/Vending ($20,155), Storage Lot Lease ($22,200), Pizza/Market ($14,400) and Gate fee agreement ($125,000) income. No on-site rental program or operator monopoly appears in any document.
VotesOne voting member per unit; 3 votes per two-bedroom and 2 per one-bedroom apartment, 718 total; majority = 51% of total votes; quorum 51% (reducible to 1/3 by Board action); proxies allowed (filed 15 days before a regular meeting); written consent in lieu of meeting needs 67% (By-Laws Art. VII, XI; Master Deed Art. II Sec. 3).
Changing the deedMaster Deed 67% of all voting members (Art. VI); By-Laws 67% of total vote (Art. XX); no amendment may change any apartment's percentage share or votes without all owners and all mortgagees joining; alterations/additions to common elements need Board plus 75% of total votes and 90% of mortgage debt holders (Art. XII(B)); termination needs all owners and mortgagees. Rules change by Board on 30 days' notice. The regime is also 'subordinate to MBR HOA' (master association) whose Declaration its board amended by board resolution in 1998.
Disputes or lawsuitsunstated. No lawsuit or dispute document is in the set; the 2026 budget raises Legal Services from $10,000 to $25,000 without explanation.

03 Pros and cons

For the owner who runs it themselves.

The same building reads very differently to an owner on the rental program and an owner on Airbnb. This list is for the second one.

Working for you

  • The master deed expressly allows renting or leasing a unit to third parties with no minimum stay, no on-site rental program, and no requirement to use any particular manager (Master Deed, Art. XI p. 17; Rules Art. V).
  • Leasing is expressly carved out of the 'no business' rule, so short-term renting itself cannot be cited as a violation (Rules Art. II Sec. 1, p. 3).
  • Guests and tenants get the same amenities as owners and the rules flatly prohibit any amenity or usage fee for pools, the lazy river or other common elements (Rules Art. VI p. 9; Art. VIII Sec. 2 p. 11).
  • Owners may post one small professional 'For Rent' sign in the hallway window and the HOA sells hallway-door lockboxes, which supports self check-in (Rules Art. II Sec. 17(a) p. 6; Sec. 6(c)(4) p. 3).
  • Reserve funding of $350,000 is about 15.6% of the $2.24M 2026 budget and was held flat from 2025, and a reserve study was budgeted in 2025 (Budget 2026, Income p. 1; Other Expenses p. 2).
  • Total budget fell 1.1%, regular assessments fell 4.3% and the insurance assessment fell 9.7% from 2025 to 2026; new non-dues income (gate fee agreement $125,000, pizza/market, storage lot) offsets owner assessments (Budget 2026 pp. 1-2).
  • Dues are allocated by a simple fixed vote/percentage schedule (3 votes per two-bedroom, 2 per one-bedroom) that cannot be changed without every owner's consent (Master Deed Art. VI p. 9; Exhibit 2-1).
  • Owner-elected seven-member board with two-year staggered terms, quarterly meetings, 67% supermajority for deed and by-law changes, and no commercial unit or rental-desk monopoly inside this regime (By-Laws Art. VIII Sec. 1; Master Deed Art. VI).
  • Fines are capped at $1,500 per year with written notice and a 15-day hearing right (Rules Exhibit A Fine Policy, p. 13).

Watch-outs

  • Two-tier structure: the regime is 'subordinate to MBR HOA', the master association controls the security gate, charges guest entry fees (e.g., bike-week trailers), approves all exterior changes, and takes $437,263 (19.5% of the 2026 budget) as MPOA Assessments; its Declaration, rules, pass/decal system and budget are NOT in this document set (Rules Art. X p. 11, Art. III p. 7, Art. II Sec. 24 p. 7; Budget 2026 p. 2).
  • Insurance is 37% of the budget ($835,000 in 2026, $925,000 in 2025) and is billed as a separate monthly Insurance Assessment under the deed's Insurance Trustee mechanism, which can also assess owners for a self-insurance fund to cover deductibles; wind/flood deductibles and carrier are unstated (Master Deed Art. X Secs. 1, 3 pp. 12-13; Budget 2026 p. 1).
  • Short-term leases (under 90 days) must include an occupant aged 23 or older; this rule lives in both the regime's rules and the master association's Declaration, so it cannot be changed by this regime's owners alone (Rules Art. V(d)(2) p. 9; 1998 Amendment Sec. 6.8(b)).
  • Owners must register their rental agent with Management and are 'ultimately responsible' for tenant fines (up to $100/day general, $500 per health-safety occurrence, $1,500/year) plus enforcement attorneys' fees; the deed also lets the Board bar a renter from the property and lien the unit for removal costs (Rules Art. V(a),(c) p. 9; Exhibit A p. 13; Master Deed Art. XI p. 17).
  • All unit locks must be keyed to the Association's master maintenance key system via the HOA-approved locksmith and the Board may hold a key; only HOA-purchased lockboxes are allowed, so an owner cannot freely install smart locks or third-party lockboxes (Rules Art. II Sec. 6(d), Sec. 19 pp. 3, 6).
  • No pets for guests or tenants and short-term renters cannot claim an emotional-support animal; service/ESA animals need 30-day advance registration (Rules Art. II Sec. 16 p. 5), and no washers/dryers may be installed in units (Rules Art. III amendment Sept. 1, 2022 p. 7).
  • The 1982 deed still carries Declarant rights that cannot be amended without the Declarant's consent: the Article XV rights (exclusive utility/TV/phone contracting, free rental of its own units, sales/rental offices) last only while the Declarant owns an apartment, but the easement/beach-license rights and the Resort Facilities regime ('Resort Expenses' paid to the Declarant or 'Present Owner', which sets the Resort Facilities rules) have no sunset; whether a successor still owns a unit or exercises any of this is unstated (Master Deed Art. VI p. 9, Art. XIV p. 22, Art. XV Sec. 1 pp. 22-24, Art. XVIII pp. 26-28).
  • The 1982 deed allows the Board to require Board permission and a fee for guests' use of common elements; the 2022 rules currently waive fees, but rules can be changed by the Board on 30 days' notice (Master Deed Art. III Sec. 3 p. 6; Rules Preamble p. 1).
  • Maintenance staff cost jumped 42% ($300,000 to $426,211), legal services rose from $10,000 to $25,000, and the building dates from 1982; reserve balance, reserve study results, audited financials and special-assessment history are not in the set (Budget 2026 pp. 1-2).
  • Contractor rules are strict: proof of license and insurance to the Association before any interior work, 8-5 Monday-Saturday hours, no Sunday work, debris out by 6 p.m., and interior wall/plumbing/electrical changes need written approval (Rules Art. III-IV pp. 7-9).
  • Guests may not bring utility trailers at any time and motorcycles must park in designated lots away from the building; delinquent owners' guests are refused entry to the regime (Rules Art. II Secs. 24-25 p. 7; By-Laws Art. XII Sec. 5).
  • The 1982 By-Laws and deed supplied are original versions; any recorded amendments since 1982 (other than the 2022 rules) are not in the set, and the unit count in Exhibit 2 (215/36) conflicts with Article III (216/35) (Master Deed Art. III Sec. 6(a) p. 6; Exhibit 2-1).
04 The money

What you pay, and where it goes.

06 Before you write an offer

What to ask the association for.

The documents we had leave these open. Ask for them in the due-diligence period and the score firms up.

Documents read October 2026. Full read: Deed, rules and the money were all on file.

Read this before relying on anything aboveEvery statement on these pages is read from the association's own recorded documents, named on the page, as they stood on the date shown. Boards amend rules, budgets change every year, and a recorded amendment can change a score overnight. Confirm anything you would rely on with the association or your closing attorney before you write an offer. This is not legal, tax or investment advice.
The next step

Have the documents read
for the building you are weighing.

This page says what the association's documents allow, require and cost. It cannot tell you which unit is listed this week, or what the seller's estoppel will say. Tell us the resort and we will read its documents against this framework, or pull them if you are under contract.

We use the numbers on this page to answer you specifically. No list, no drip sequence — a person reads it.
