What the documents decide
before your first guest books.

Five dots is the best answer for an owner who wants to run the unit themselves. One dot is a red flag. Open “What the documents say” under each for the exact words.

01

Can you rent it your way?

Typical

Whether the deed and rules let you rent short-term on your own terms: no requirement to use the on-site program, no minimum stay that kills weekend bookings, and no rule against saying where the condo is.

STR with no minimum stay and self- or off-site management is expressly allowed by the deed, but Board rules impose a mandatory disclaimer, bar referencing resort amenities and require an occupancy registry with a 30-minute contact.

Short-term rentalsAllowed
Must use on-site programNo
Owner may rent it personallyYes
Off-site manager allowedYes
Owner-use limitsunstated (no owner-use limits; residential use by owners, families, guests and invitees; timeshare/interval ownership prohibited)
RegistrationAn occupancy registry with the Association giving a record of all persons occupying units and their contact information, plus a single point of contact for the renting owner who can respond within 30 minutes to violations or emergencies (Rules 2021, UNIT OCCUPANCY). Association must hold a working key or access code to every unit (Rules, KEYS; Master Deed Art. XVIII). Owners must notify the Association in writing on purchase (Master Deed Art. XXVII).
Advertising rulesOwners renting personally or through an off-site manager must refrain from referencing the availability of the on-site commercial services/amenities (the garbled sentence appears to also cover photographs), and all electronic, digital, print or other listings must carry the required disclaimer. Guests must receive a copy of the Rules before arrival. No 'FOR RENT'/'FOR SALE' signs without Association approval (Rules 2021, COMMERCIAL AREAS and SIGNS).
Disclaimer in your listingRequired

Will your guests be treated like guests?

Caution

Whether a guest who booked through you gets the same resort as a guest who booked through the front desk: the same pools, parking, wristbands and check-in, or a second-class version of them.

Off-program guests use the building pool/spa with owner-distributed wristbands and parking passes, but get no front desk, no trash chute, and are excluded from the water park, restaurant, the Rusty Reel, gift shop and guest laundry, with the exclusion printed in every listing.

Amenities for your guestsMost, not all
Off limits to your guestsFront-desk service, Guest laundry on the 2nd floor, The Cove Water Park (registration building), Papa's Restaurant, The Rusty Reel, The Harbor Gift Shop, Trash chutes (exclusive to the Commercial Unit Owner)
Wristbands & parking passesAssociation sends 'several' wristbands to non-program units near the start of each year; more can be requested from the Association Office Monday-Friday 9AM-5PM. Parking passes are sent to non-program units to distribute to guests. Cost: unstated. Guests must wear pool bands on the pool deck. Vehicles must fit one marked space; no trailers/boats/RVs; towing at owner's expense.
Check-inowner handles (disclaimer states rental does not include any form of front-desk service)
TrashNon-program units may not use the trash chutes; all trash must be bagged in heavy-duty plastic and carried to the compactor beside the parking garage at 2090 Withers Ave. No bags outside unit doors. Bulky items must go to an off-site dump at owner's expense.
Elevatorsunstated (one passenger elevator plus two stairways are common elements per Exhibit B; no service-elevator or vendor-elevator rule stated)
Housekeeping & linenunstated (HOA budgets pool towels and laundering; in-unit housekeeping and linen are not addressed)

How much work lands on you?

Caution

What the rules make the owner personally responsible for: a local contact who answers in minutes, keys and passes, trash, fines for guest behaviour, vendor hours and elevators.

A 30-minute response contact, occupancy registry, trash carried to an off-street compactor, pre-arrival rules delivery, key deposit and fines from $200 plus $50/day for guest conduct go well beyond normal hosting.

Local contactA singular point of contact for the renting owner must be on the occupancy registry and able to respond on behalf of the unit within 30 minutes to any rule violation or emergency.
Response time30 minutes (Rules 2021, UNIT OCCUPANCY)
Locks & keysAssociation must have a working key or access code to every unit; entry door and lock modifications require Board approval; no lockboxes in hallways or stairwells. If no key is deposited, the Association may charge the owner for making one.
FinesWarning first; repeated or continued violations (during owner or guest occupancy) may bring fines and/or legal action against the owner. Fines start at $200 per infraction plus, for wilful violations, $50 per day until remedied; smoking/vaping fines start at $250 per occurrence; throwing anything off a balcony results in eviction of all guests from the unit. Fines are a lien on the unit and a personal obligation of the owner; Board hearing decision is final. By-Laws say a fine is first assessed to the occupant and falls to the owner if unpaid.
Contractors & vendorsContractors must be licensed in Horry County and the City of Myrtle Beach, insured for liability and workers' comp with a certificate naming the Association as additional insured, work only 9:00AM-5:00PM, sign in and get a name tag at the front desk in the Breakers registration building before entering. No tile cutting on balconies or perforating the exterior skin. Owner liable for any common-element damage by their contractor. Move-ins/outs only during business hours and coordinated with building maintenance.
AlsoOwner must carry an HO-6 policy with liability and contents if not provided by the HOA (the HOA budgets a 'Master HO6 Insurance' line). Owner maintains all in-unit systems including HVAC, appliances, window glass, doors, door/window frames and balcony surfaces/railings; Association sprays each unit monthly for pests. Owner pays insurance deductible portion for in-unit repairs. Window treatments must have a uniform white backing; balcony furniture must be brown unless approved. No pets at all. Non-smoking property including inside units and balconies.

Is the money healthy?

Typical

Whether the association can pay for the building without surprise bills: reserves, special assessments, insurance deductibles, how fast dues are rising, and how much of the fee passes through to a master association.

Reserve funding is a healthy 21.9% of budget, no special assessments appear and 2025 dues rose only 3.1%, but insurance is roughly 35% of the budget after a 45.7% jump that drove a 12.8% dues increase in 2024, and no reserve balance, reserve study or deductible figures are on file.

2025 budget$559,480
Dues change+3.1% on the year
Reserves22% of budget
Special assessmentsNone in the documents
Insurance2025 'Insurance Expense' $168,000 plus 'Master HO6 Insurance' $26,500 = $194,500 (34.8% of budget), both billed to owners as separate monthly insurance and HO6 components. 2024 was $188,000 + $28,000 = $216,000 (39.8% of a $542,489 budget) after a 45.7% jump from 2023 ($129,000 + $24,000; 2023 also carried a $12,000 insurance contingency). Insurance fell 10.6% in 2025. Master Deed Art. XXV requires full-replacement casualty cover including windstorm, wind-driven rain and water damage, liability, workers' comp and D&O; deductibles are not stated. Owners pay the deductible share on in-unit repairs (Art. XXII).
DelinquencyAssessments in default if unpaid by due date; Board may accelerate the whole annual assessment on 10 days' notice; after 20 days the Association may enforce including foreclosure; 18% per annum interest; $25 late fee per installment unpaid 30 days; lien plus attorney's fees; in a foreclosure suit the Association is entitled to rental from the owner and a receiver. By-Laws: monthly installment delinquent on the 15th. Reserve funds may not be used for operations except by 75% Board vote and must then be replenished by a special assessment within 90 days.

Who's really in charge?

Typical

Who holds the power the documents hand out: an owner-elected board, or a developer or commercial-unit owner with deed-level rights over rentals, guest services and the building's name.

Owner-elected board with ordinary 67% amendment rules and no deed-level rental monopoly, but a Commercial Unit controls the trash chutes and an undocumented on-site operator enjoys amenity exclusivity that the Board has written into the rules.

StructureOne association
Commercial unitYes, with its own deed rights
BoardFive directors after developer control ended (initially staggered 3/3/2/2/1-year terms, then 2-year terms), nominated by a nominating committee with floor nominations, elected by plurality; any director removable by majority vote of the membership. At least four Board meetings a year, open to members. Officers elected annually by the Board. Management contracts limited to one year and terminable on 90 days' notice without penalty. Audited annual financial statements required.
Developer rightsDeveloper (Class II member, 4 votes per unit owned) controlled the Board and held a veto over all Board actions until Class II control ended, which the deed and By-Laws fix at no later than December 31, 2009. Right to add Phases II-V expired 20 years after the June 1999 filing. Still-surviving developer reservations: perpetual commercial use of the name 'Sailfish Resort' and signage rights not tied to owning any unit; a perpetual telephone/cable easement in favor of Sailfish Management, Inc. (equipment remains that company's property); developer written consent required to amend the maintenance-schedule article (XXIII) and the reserve-fund paragraph (XXVIII.E) or any grantor-reserved right.
Commercial-unit rightsNo deed-level rental monopoly: the Master Deed expressly preserves every owner's right to rent for any length of time. However, one unit (type 'D', unit 212) holds the trash and laundry chutes, electrical, mechanical and fire-control rooms as limited common elements, and the 2021 Rules treat that owner as the 'Commercial Unit Owner' running an on-site rental program whose guests alone get front-desk service and the adjacent Breakers commercial amenities. Those amenities sit on third-party hotel property in which owners have no rights. The Board has adopted rules that restrict off-program advertising and require a disclaimer.
VotesOne vote per unit (Class I); co-owners designate one voting member; proxies allowed; quorum 51% of total votes; majority = more than 50%. Class II developer super-voting has terminated by its own terms.
Changing the deedMaster Deed: 67% of members owning a unit, at a special meeting called on 20-60 days' notice; unanimous consent (plus mortgagees) to change percentage interests or the assessment basis; grantor/lender consent to touch their reserved rights. By-Laws: 67% of total votes including 67% of non-developer votes, effective on recording. Termination of the regime: unanimous owners and lienholders.
Disputes or lawsuitsunstated (no litigation, complaint or dispute is mentioned in any document in the set; the Parking Agreement contains a mandatory arbitration clause for cost-sharing disputes with the parking-lot owner)
What the documents say (8)
“The power of the GRANTOR to designate Directors as above referred to shall terminate no later than the 31st day of December, 2009, notwithstanding that additional phases may thereafter be added to Sailfish Resort Horizontal Property Regime.”Master Deed, Article XXXIII, page 32
“At the first annual meeting after the termination of Class II control, five (5) Directors shall be elected.”Master Deed Exhibit E By-Laws, Article III Section 6, page 54
“Any Director of the Association may be removed, with or without cause, by a vote of the Voting Members with a majority vote of the membership.”Master Deed Exhibit E By-Laws, Article III Section 7, page 54
“Further, GRANTOR shall have the right to (i) the commercial use of the name "Sailfish Resort"; and (ii) to affix and maintain signs on the Property identifying and/or advertising the name of the Property, of GRANTOR and/or of any business or service of GRANTOR or any licensee of GRANTOR, which such right shall not be contingent upon GRANTOR'S ownership of any minimum number of UNITS.”Master Deed, Article VIII, page 9
“The GRANTOR may elect to exercise this right or option as to Phases II through V, no later than twenty (20) years from the filing of this Master Deed.”Master Deed, Article III, page 4
“these By-Laws may be amended only by the affirmative vote (in person or by alternate) or written consent of Voting Members representing sixty-seven (67%) percent of the total votes of the Association, including sixty-seven (67%) percent of the votes of Members other than the GRANTOR.”Master Deed Exhibit E By-Laws, Article VI Section 6, page 63
“No management contract may have a term in excess of one (1) year and must permit termination by either party without cause and without termination fee or penalty on ninety (90) days' or less written notice.”Master Deed Exhibit E By-Laws, Article III Section 19(b), page 58
“The provisions of this Section XXIII may not be amended without the express written consent of the GRANTOR.”Master Deed, Article XXIII, page 17
03 Pros and cons

For the owner who runs it themselves.

The same building reads very differently to an owner on the rental program and an owner on Airbnb. This list is for the second one.

Working for you

  • The deed guarantees owners may rent for any length of time and cannot be forced into any program; nightly rentals and self-management are permitted (Master Deed, Art. XV p.11-12).
  • The Rules expressly contemplate owners renting 'personally, or through an off-site rental management company' (Rules 2021, COMMERCIAL AREAS p.3).
  • Owner-elected five-member board; developer board control and veto expired no later than December 31, 2009; directors removable by simple majority (Master Deed Art. XXXIII p.32; By-Laws Art. III Sec. 6-7 p.54).
  • Reserve funding of $122,500 is 21.9% of the 2025 budget, up from $100,000 in 2024, and reserves can only be raided by a 75% Board vote with mandatory replenishment within 90 days (2025 Budget p.1; Master Deed Art. XXVIII.E p.24).
  • 2025 dues rose only 3.1% ($30/month on a one-bedroom) and insurance cost fell about 10.6% from 2024 (2025 Budget p.1).
  • Dues bundle building insurance, an HOA-purchased HO-6 layer, cable, internet, water/sewer, trash, monthly in-unit pest control and security patrol (2025 and 2024 Budgets p.1).
  • Non-program owners are sent wristbands and parking passes each year, and the covered pool, spa and pool deck in the building are common elements open to all owners' guests (Rules 2021 WRISTBANDS p.2, PARKING p.3; Master Deed Exhibit B p.38).
  • No special assessments are mentioned anywhere in the set, and the deed requires a professional engineering inspection of the common elements every three years (Master Deed Art. XXIII p.17).
  • Management contracts are capped at one year and terminable on 90 days' notice without penalty, and audited annual financials are required (By-Laws Art. III Sec. 19-20 p.58-59).

Watch-outs

  • Off-program guests get no front desk and no access to the water park, restaurant, the Rusty Reel, gift shop or 2nd-floor guest laundry, and every listing must carry the capitalised disclaimer saying so (Rules 2021, COMMERCIAL AREAS p.3-4).
  • Off-program listings may not reference the on-site commercial services or amenities, and the Board can rewrite the Rules on its own at any time (Rules 2021, COMMERCIAL AREAS p.3 and PLEASE NOTE p.4).
  • A single point of contact must be able to respond on behalf of the unit within 30 minutes to any violation or emergency, and the Association must hold a record of every occupant (Rules 2021, UNIT OCCUPANCY p.4).
  • The trash chutes belong to the Commercial Unit; non-program units must bag trash and carry it to the compactor at 2090 Withers Ave, and bulky items must be hauled to an off-site dump at the owner's expense (Rules 2021, TRASH p.3; Master Deed Exhibit B p.40).
  • Fines start at $200 per infraction plus $50 per day for wilful violations, $250 per occurrence for smoking/vaping, and they attach as a lien and personal obligation of the owner even for guest conduct; throwing anything off a balcony gets all guests evicted (Rules 2021, VIOLATIONS p.4, SMOKING p.3, BALCONIES p.2).
  • Insurance is the largest cost: $168,000 plus $26,500 HO-6 is about 35% of the 2025 budget, and it jumped 45.7% in 2024, which drove a 12.8% dues increase that year (2025 and 2024 Budgets p.1).
  • No reserve balance, reserve study, triennial engineering report or insurance deductibles are in the set, and the deed's Exhibit G maintenance schedule is unreadable in the OCR (Master Deed Exhibit G p.80; 2025 Budget p.1).
  • Non-smoking property including inside units and balconies, and no pets of any kind, which narrows the guest pool (Rules 2021 SMOKING p.3, PETS p.2; Master Deed Art. XVI p.12).
  • 38 of the 54 required parking spaces are on a neighbour's lot under an easement the lot owner may relocate at will, and that lot owner keeps the use of any spaces beyond the 38 for its own purposes (Master Deed Exhibit F, Parking Agreement paras. 2, 4-5 and 8, p.67-69).
  • Contractors must be City- and County-licensed, carry a COI naming the Association, work 9-5 only and sign in at the Breakers front desk; owners are liable for any common-element damage they cause (Rules 2021, UNIT MAINTENANCE / CONTRACTOR WORK p.4).
  • Delinquent dues accrue 18% interest, a $25 late fee, acceleration of the whole year and foreclosure with a rental receiver (Master Deed Art. XXVIII.H and L, p.25-26).
  • The commercial operator's identity, its agreement with the HOA and the Commercial Unit's obligations are not documented anywhere in the set; the on-site 'resort' amenities are on third-party hotel land in which owners have no rights (Master Deed Art. III p.5-6).
04 The money

What you pay, and where it goes.

06 Before you write an offer

What to ask the association for.

The documents we had leave these open. Ask for them in the due-diligence period and the score firms up.

Documents read October 2026. Full read: Deed, rules and the money were all on file.

Read this before relying on anything aboveEvery statement on these pages is read from the association's own recorded documents, named on the page, as they stood on the date shown. Boards amend rules, budgets change every year, and a recorded amendment can change a score overnight. Confirm anything you would rely on with the association or your closing attorney before you write an offer. This is not legal, tax or investment advice.
The next step

Have the documents read
for the building you are weighing.

This page says what the association's documents allow, require and cost. It cannot tell you which unit is listed this week, or what the seller's estoppel will say. Tell us the resort and we will read its documents against this framework, or pull them if you are under contract.

We use the numbers on this page to answer you specifically. No list, no drip sequence — a person reads it.
